How we collect, use and protect your personal information.

Propertywise AU Pty Ltd ABN 89 689 657 396 (Property Wise, we, us, our or the Company) is committed to protecting your privacy. This Privacy Policy explains how we collect, hold, use and disclose your personal information when you use our website and landing pages, fill in a form, book a discovery session, watch our training, contact us, attend an event or become a Member.

1. The Australian Privacy Principles

We handle personal information in line with the Privacy Act 1988 (Cth) (Privacy Act) and the 13 Australian Privacy Principles (APPs), which govern how personal information is collected, used, disclosed, stored and corrected.

2. What is personal information?

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. The personal information we may collect includes:

a. your name and date of birth;

b. your contact details, such as your address, mobile number and email address;

c. financial information, such as your income range, savings, equity, existing properties, borrowing position and, if you buy a Membership, your payment details;

d. information about your property goals and interests, such as the type of property, location, budget and timeframe;

e. information about your computer or device and your connection to our website;

f. identity verification information, such as copies of government-issued identification documents;

g. where required for identity verification, biometric information such as facial images and liveness checks; and

h. information about whether you are a politically exposed person or subject to sanctions, where required by law.

3. How we collect personal information

We collect personal information when you:

a. visit our website or landing pages;

b. fill in a form, such as our free guide, free training, booking or contact forms;

c. answer our pre-qualification questions or book a discovery session;

d. call, email, message or meet with us;

e. attend one of our events or webinars;

f. apply for or buy a Membership; or

g. complete identity verification.

We may also collect personal information from third parties where you have agreed or the law allows, such as identity verification providers, professionals you ask to share information with us, and advertising platforms that tell us how you reached our website.

4. Sensitive information and identity verification

We only collect sensitive information, including biometric information, with your consent or where the law requires or allows it.

Where we need to verify your identity, for example when you become a Member, we may use an electronic identity verification provider. This may involve comparing a photo of your face with your identification document and a liveness check. Biometric information is sensitive information under the Privacy Act.

5. SMS communications

If you give us your mobile number and agree to receive SMS, we may send you text messages about your enquiry, including follow-ups, appointment reminders and marketing. You can opt out at any time by replying “STOP” or by contacting us (see section 15). Agreeing to receive SMS is not a condition of any purchase.

6. IP addresses

We collect and manage IP addresses as part of running our website, including for security and fraud prevention.

7. Cookies, pixels and analytics

Our website and landing pages use cookies and similar tools.

a. Persistent cookies stay on your device after you close your browser, so we can remember your preferences next time.

b. Session cookies are deleted when you close your browser.

We use cookies to remember your preferences, keep track of details you submit, measure how our website is used and show you relevant content.

We also use third-party tools, including Google Analytics (to understand how people use our website, using de-identified data) and the Meta Pixel (to measure our Facebook and Instagram ads and show relevant ads). Social media features from platforms such as Facebook, Instagram, LinkedIn and YouTube may also set cookies.

You can set your browser to accept or refuse cookies. If you refuse them, some parts of our website may not work properly.

8. Re-marketing

We may use Google and Meta (Facebook and Instagram) re-marketing services to show our ads to you on other websites and apps after you visit our website. You can change your Google ad settings at https://www.google.com/settings/ads and your Meta ad preferences in your Facebook or Instagram settings.

9. How we use personal information

We may use your personal information to:

a. send you the free guide, training or other resources you ask for;

b. respond to your enquiries and arrange your discovery session;

c. understand your situation so we can show you what a realistic property plan could look like;

d. process your Membership application, purchase and billing;

e. provide our services, including strategy, research, property presentations and introductions to other professionals;

f. verify your identity and meet our obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (AML/CTF Act) and other laws, where they apply to us;

g. prevent misuse and fraud;

h. send you news, information and offers about property and our services (you can unsubscribe at any time);

i. ask for your feedback;

j. research, measure and improve our website, ads and services; and

k. run our business and maintain our systems.

From time to time we may email our contacts and Members with news, information and offers. Every marketing email includes an unsubscribe link, or you can contact us to opt out.

10. Who we disclose personal information to

We may disclose your personal information, where appropriate and lawful, to:

a. our staff and contractors, including team members located in the Philippines;

b. service providers who help us run our business, such as our CRM and booking platform, email and SMS providers, website hosting, file storage and analytics providers;

c. advertising platforms such as Meta and Google;

d. our identity verification provider and its partners;

e. professionals and businesses you ask us to introduce you to, or that are needed to complete a property purchase, such as mortgage brokers, lenders, solicitors, conveyancers, accountants, property managers, insurers, quantity surveyors, developers, builders, vendors and agents (see our Membership Terms);

f. your authorised representatives or legal advisers;

g. our professional advisers, such as accountants, auditors and lawyers;

h. fraud prevention organisations;

i. government and regulatory authorities, including AUSTRAC (the Australian Transaction Reports and Analysis Centre) where required; and

j. police or other appropriate persons where we suspect unlawful activity.

We do not sell your personal information.

11. Overseas disclosure

Some of our team members and service providers are located, or store information, outside Australia, including in the Philippines and the United States. Where we disclose personal information overseas, we take reasonable steps to make sure it is handled in a way that is consistent with the APPs.

Where we use an identity verification provider, we take reasonable steps to make sure identity and biometric information is stored securely and handled in line with the APPs.

12. Access to your personal information

In most cases you can ask to see the personal information we hold about you. Please make your request in writing to the contact details in section 15. We may need to confirm your identity first. How long it takes depends on how much information is involved, and we may charge a reasonable fee to cover the cost of retrieving it (but not for making the request).

We may refuse access where the law allows, for example where giving access:

a. would be unlawful;

b. would unreasonably affect another person’s privacy;

c. could prejudice the investigation of unlawful activity; or

d. relates to existing or expected legal proceedings.

If we refuse, we will tell you why, unless the law stops us.

AML/CTF confidentiality: the AML/CTF Act may stop us from telling you whether we have made, or are considering making, a report to AUSTRAC. This may mean we cannot explain some decisions about your Membership or answer some requests for information.

13. Correcting your personal information

If you tell us that personal information we hold about you is inaccurate, incomplete or out of date, we will correct it. If we disagree that it needs correcting, we will tell you why and, if you ask, take reasonable steps to attach a statement of your view to the record.

14. Storage, security and how long we keep it

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, change or disclosure. These steps include password-protected systems, access controls, firewalls, anti-virus software and email filtering for electronic records, and physical security for paper records.

We keep personal information only for as long as we need it or as the law requires:

a. AML/CTF records, including identity verification records, are kept for at least 7 years after your Membership ends;

b. biometric information is destroyed or de-identified once verification is complete; and

c. other personal information is kept only as long as reasonably needed for the purposes in this policy, then destroyed or de-identified.

If we have a data breach that is likely to cause serious harm, we will follow the Notifiable Data Breaches scheme where it applies to us.

We will acknowledge your complaint promptly and aim to respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at https://www.oaic.gov.au.

16. Third-party websites

This Privacy Policy applies to our own websites and landing pages only. We are not responsible for the content or privacy practices of other websites, including booking, payment or training pages run by third parties.

17. Changes to this policy

We may update this Privacy Policy from time to time. The latest version will always be on our website, with the date it was last updated, and any changes will be made in line with the Privacy Act and the APPs.
